Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Brave Waffles, LLC ("Brave Waffles", "we", "us") governing your use of Consistent Notes, our macOS journaling app (the "app"), and bravewaffles.io.

By downloading or using the app, you agree to these Terms. If you don't agree, don't use the app.

The app is distributed through Apple's App Store and is licensed to you under Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"). These Terms supplement the Apple Standard EULA. If these Terms conflict with the Apple Standard EULA regarding your license to use the app, the Apple Standard EULA wins.

1. Your Notes Are Yours

You own everything you write in Consistent Notes — every note, every ToDo.

We claim no ownership interest or license in your content. Consistent Notes stores your notes locally on your Mac, and Brave Waffles does not receive, access, read, or store the contents of those notes.

The .md files created by the app are ordinary files stored on your disk and can be accessed independently of Consistent Notes.

2. Subscriptions

Some features of Consistent Notes may require a paid subscription.

Subscriptions are purchased and billed through Apple's App Store and renew automatically unless canceled. Current pricing, trial terms, subscription periods, and renewal information are shown in the app or through your App Store account before purchase.

Apple handles subscription billing, cancellation, and refunds under its applicable terms and policies.

You can view, change, or cancel your subscription at any time through your App Store account settings.

If your subscription ends, features requiring an active subscription may become unavailable. Your locally stored notes remain yours.

3. Acceptable Use

You agree to use Consistent Notes and our website lawfully and in a way that does not violate the rights of others.

You may not attempt to bypass, disable, interfere with, or defeat security, licensing, subscription, or other technical protections associated with the app.

Your notes are yours, and you are solely responsible for the content you create or store using the app.

4. Your Data and Backups

Consistent Notes is designed to store your notes locally on your Mac rather than on Brave Waffles servers.

Because Brave Waffles does not possess a copy of your notes, we cannot recover them if they are deleted, corrupted, lost, or otherwise become inaccessible.

You are responsible for maintaining appropriate backups of your files. macOS features such as Time Machine may help you do this.

5. Disclaimers and Liability

To the maximum extent permitted by applicable law, Consistent Notes and bravewaffles.io are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the app or website will always be available, uninterrupted, error-free, or free from data loss.

To the maximum extent permitted by law, Brave Waffles will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, business opportunities, or data arising from or related to your use of the app or website.

To the maximum extent permitted by applicable law, Brave Waffles's total liability arising out of or relating to the app, website, or these Terms will not exceed the amount you paid to Brave Waffles through the App Store during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the fullest extent permitted by law and do not limit rights that cannot legally be waived.

6. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. To the extent permitted by applicable law, any dispute arising out of or relating to these Terms will be brought in the state courts located in Cobb County, Georgia, or the United States District Court for the Northern District of Georgia.

Nothing in these Terms limits any consumer protection rights or other rights you may have under mandatory laws that apply to you.

7. Changes to These Terms

We may update these Terms from time to time.

When we do, we'll post the updated version here and change the "Last updated" date.

If we make a material change that significantly affects how Consistent Notes works or how your information is handled — for example, introducing an optional sync service that sends your notes off your Mac — we'll provide reasonable notice before the change takes effect.

Your continued use of the app after updated Terms take effect means you accept the updated Terms, to the extent permitted by applicable law.
